Refund & Cancellation Policy
1. Scope of Policy
This Refund & Cancellation Policy applies to all offerings provided by SmartX CRM, including but not limited to:
- SaaS (Software as a Service) products
- CRM subscriptions
- Custom software development
- Website & application development
- Digital/IT consulting services
- Licensing and digital products
2. General No-Refund Policy
2.1 All payments made to SmartX CRM are final and non-refundable.
2.2 Due to the nature of IT services and digital products, no refunds shall be issued once:
- Subscription is activated
- Project work has commenced
- Digital product/license is delivered
- Access credentials are shared
2.3 This policy applies irrespective of usage, satisfaction level, or project status.
3. SaaS & Subscription Services
3.1 All CRM/software subscriptions are billed in advance on a recurring basis.
3.2 Once subscribed:
- Fees are non-refundable
- Services remain active for the paid billing period
3.3 Cancellation:
- Clients may cancel anytime
- Cancellation applies to the next billing cycle only
- No partial refunds or adjustments
4. Custom Development & IT Services
4.1 For website, app, or software development projects:
- Payments made for milestones, phases, or advance booking are non-refundable
4.2 Once project execution begins:
- No cancellation will result in a refund
- Work completed till date remains chargeable
4.3 Delays caused by client-side dependencies (content, approvals, data) shall not be grounds for refund.
5. Digital Products & Licensing
5.1 All digital products including:
- Software licenses
- Templates
- Source code
- Plugins or tools
are non-refundable and non-returnable once delivered or accessed.
6. Non-Dispute & Chargeback Policy
6.1 By making payment, the client agrees not to initiate chargebacks or disputes with banks or payment gateways.
6.2 Any violation may lead to:
- Immediate suspension of services
- Termination of account access
- Legal action, if necessary
7. Exceptional Cases (Limited Review Only)
7.1 SmartX CRM may review exceptional situations such as:
- Complete failure to provide agreed core service
- Verified critical technical issues solely attributable to the Company
7.2 In such cases, resolution may include:
- Service credits
- Project revision
- Subscription extension
7.3 No monetary refunds will be issued under any circumstances.
8. Limitation of Liability
SmartX CRM shall not be held liable for:
- Business loss
- Data loss
- Profit loss
- Indirect or consequential damages
arising from the use or inability to use its services or products.
9. Policy Updates
The Company reserves the right to modify this policy at any time without prior notice. Continued use of services constitutes acceptance of updated terms.
10. Governing Law
This policy shall be governed by the laws of India. Any disputes shall fall under the jurisdiction of the courts at the Companyโs registered location.
