Refund and Cancellation Terms & Conditions

1. Acceptance of Terms

By subscribing to or using any services provided by SmartX CRM (“Company”), the user (“Subscriber”) expressly agrees to be bound by the following Refund and Cancellation Terms & Conditions.

Failure to agree with these terms prohibits the use of the Company’s services.


2. Subscription Model

All services offered by the Company are provided strictly on a prepaid subscription basis for a defined billing cycle (monthly, quarterly, yearly, or as applicable).


3. No Refund Policy

3.1 All payments made to SmartX CRM are final and non-refundable.

3.2 The Company shall not be liable to issue refunds under any circumstances, including but not limited to:

  • Partial or non-usage of services
  • Change in business requirements
  • User dissatisfaction
  • Early termination of subscription by the Subscriber

3.3 By completing a subscription payment, the Subscriber irrevocably waives any right to claim a refund.


4. Cancellation Policy

4.1 Subscribers may request cancellation of their subscription at any time by contacting the Company’s official support channel.

4.2 Cancellation requests shall only apply to future billing cycles.

4.3 Upon cancellation:

  • The current subscription shall remain active until the end of the paid billing period.
  • No prorated refunds or credits shall be provided for the remaining duration.

4.4 The Company is under no obligation to process retroactive cancellations.


5. Non-Dispute Clause

5.1 The Subscriber agrees that the Company’s No Refund Policy is absolute and binding.

5.2 The Subscriber shall not initiate or pursue any dispute, chargeback, or claim with payment processors, banks, or financial institutions in relation to subscription fees.

5.3 Any such action may result in immediate suspension or termination of services without notice.


6. Exceptional Circumstances

6.1 Notwithstanding the above, the Company reserves the sole and exclusive right to review exceptional cases, including but not limited to:

  • Verified technical failure attributable to the Company
  • Complete inability to deliver subscribed services

6.2 In such cases, the Company may, at its sole discretion, offer:

  • Service credits, or
  • Subscription extensions

6.3 Such remedies shall not be construed as a refund and shall not establish precedent.


7. Limitation of Liability

Under no circumstances shall SmartX CRM be liable for any direct, indirect, incidental, or consequential losses arising from the use or inability to use its services.


8. Modifications to Policy

The Company reserves the right to modify, update, or amend these Terms & Conditions at any time without prior notice. Continued use of services constitutes acceptance of the revised terms.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in the Company’s registered location.
